In the Commonwealth, “developmental disabilities” is defined as:“a severe, chronic disability of an individual that

  • is attributable to a mental or physical impairment, or a combination of mental and physical impairments, other than a sole diagnosis of mental illness;
  • is manifested before the individual reaches 22 years of age;
  • is likely to continue indefinitely;
  • results in substantial functional limitations in three or more of the following areas of major life activity: self-care, receptive and expressive language, learning, mobility, self-direction, capacity for independent living, or economic self-sufficiency; and
  • reflects the individual’s need for a combination and sequence of special interdisciplinary or generic services, individualized supports, or other forms of assistance that are of lifelong or extended duration and are individually planned and coordinated.

An individual from birth to age nine, inclusive, who has a substantial developmental delay or specific congenital or acquired condition may be considered to have a developmental disability without meeting three or more of the criteria described in clauses (i) through (v) if the individual, without services and supports, has a high probability of meeting those criteria later in life.” [Code of VA § 37.2-100]

The Virginia Home and Community Based (HCBS) Developmental Disabilities Waivers fund services and supports which help an individual with a developmental disability live an independent life in the community. These HCBS Waivers allow an individual to access individualized services and support options that provide for their medical, behavioral, and habilitation needs in the community vs. in an institution.

There are three waivers available for individuals with a developmental disability:

  • the Building Independence Waiver (BI),
  • the Family and Individual Supports Waiver (FIS), and
  • the Community Living (CL) Waiver.

Virginia currently has a waiting list to receive a waiver.

The first step to learning more about waivers is to contact your local Community Services Board (CSB) or Behavioral Health Authority (BHA). The local CSB is the first stop to being screened and assessed for waiver services. To request a screening for DD waivers, find your local CSB/BHA.

DD IN-HOME SUPPORT SERVICES

Service Definition/Description In-home support service (IHSS) is a residential service that takes place in the individual’s home, family home, or community settings that typically supplements the primary care provided by the individual, family, or other unpaid caregiver and is designed to ensure the health, safety, and welfare of the individual. The individual must be living in his own home or his family home. In-home support services are available to individuals through the Family and Individual Supports Waiver (FIS), and the Community Living (CL) Waiver.

Service include: Skill building Support Services, Support services that enable an individual to acquire, retain, or improve the self-help, socialization, and adaptive skills required for successfully living in the community.

  • Skill-building and routine supports related to ADLs and IADLs;
  • Skill-building, routine supports, and safety supports related to the use of community resources, such as transportation, shopping, dining at restaurants, and participating in social and recreational activities;
  • Supporting the individual in replacing challenging behaviors with positive, accepted behaviors for home and community environments;
  • Monitoring the individual’s health and physical condition and providing routine and safety supports with medication or other medical needs;
  • Providing supports with transportation to and from community sites and resources; and
  • Providing general supports as needed.
